| VKS Affiliate Program Operating Agreement |

The purpose of this operating agreement is to set forth vanuatukavastore.com's (referred to as VKS in the rest of this operating agreement) affiliate programs terms and conditions.
Enrollment in the VKS Affiliate program.
To begin the enrollment process, you will submit a completed Affiliate Application on the following page.
Once your application has been approved, you will receive your affiliate code and password to allow you to start marketing VKS products.
We may reject your application if we determine (in our
sole discretion) that your site is unsuitable as an Affiliate for any reason, including, but not limited to, if your site incorporates images or content that is in any way unlawful, harmful, threatening,
defamatory, obscene; harassing or racially, ethically, or otherwise objectionable; such as sites that facilitate illegal activity; depict sexually explicit images; promote violence; promote discrimination
based on race, sex, religion, nationality, disability, sexual orientation, or age; promote illegal activities or incorporate any materials that infringe or assist others to infringe on any copyright, trademark, or other intellectual property rights (collectively "Content Restrictions").
Using Links to VKS
Link means a hyper link to the VKS web site that is copied and pasted from your individual password-protected affiliate administration area on the VKS site. If the HTML code is altered in any way after copying from that web page, we take no responsibility for you receiving credit for any sale. Any change you make may cause the tracking to no longer function correctly.
As an affiliate site ("Affiliate Site"), we will make available to you banners, button links to our website and/or text links to our web site, containing Company logo and words identifying Company. In
using the links, you agree that you will take full responsibility in maintaining all such links. VKS will advise by affiliate newsletters and the VKS affiliate administration area of updated links, it is the affiliates responsibility to keep links updated once advise by VKS using these tools.
Commission Terms
Integrated into all VKS affiliate promotional materials is code specifically related to your affiliate account. when users of affiliate sites click on these banners they are directed to the VKS home page or pages within the VKS site. The affiliate code will do the following:
1. Insert a cookie onto the end users computer which will record them as being referred to the VKS site by you for a period of 144 hours. Post this period the client will not be recorded as being referred by the affiliate and no commission will be paid for purchases made by said client.
2. Initial and future purchases made by a client, using the same computer that the cookie is stored on, within the 144 hours of clicking on VKS promotional material, will be recorded under the affiliates account.
10% of initial and all future sales made by this client will be assigned to the affiliate as commission payment.
VKS affiliates will be able to access account balances via the VKS affiliate administration console. Account balances will be updated every 24 hours and are displayed in USD.
Account balances are able to be drawn on, on a monthly basis. Payments are NOT AUTOMATIC. Requests for payment are made via the affiliate administration console. All payments are made in USD
Payment Requests
Payment requests are made under the following conditions:
1. Payment requests are to be sent through on the last week of every month. Requests put in before this time will not be acted on.
2. Payment is made on the previous months account balance. For instance if the payment request is made in May, then it can only be for the account balance at the end of April.
3. The Affiliate's account balance must be over USD$100 for payment to be made. Between the amounts of USD$100 - $549 all affiliate payments are made via Paypal. For payment requests of USD $550 or over a bank wire will be used, with a bank wire cost of USD $50 deducted from the balance.
Breach of Operating Agreement.
If VKS deems that an affiliate has breached the terms of this Operating Agreement, then the affiliate account will be closed immediatly. All account balances will be deemed null and void and no further payments will be made to that affiliate.
YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AFFILIATE AGREEMENT AND AGREE TO ALL ITS TERMS AND CONDITIONS. YOU HAVE INDEPENDENTLY EVALUATED THE DESIRABILITY OF PARTICIPATING IN THE AFFILIATE PROGRAM AND ARE NOT RELYING ON ANY REPRESENTATION, GUARANTEE, OR STATEMENT OTHER THAN AS SET FORTH IN THIS AFFILIATE AGREEMENT
THIS IS A LEGAL AGREEMENT BETWEEN YOU AND VANUATUKAVASTORE.COM. BY COMPLETING THE FOLLOWING APPLICATION FORM AND POST APPROVAL OF YOUR APPLICATION YOU ARE BOUND BY THE ABOVE TERMS AND CONDITIONS IN SO FAR AS THEY RELATE TO DEALINGS BETWEEN YOURSELF AND VANUATUKAVASTORE.COM AS AN AFFILIATE. |
